Revocation
As a consumer you have the right to withdraw from the agreement within a cooling-off period of 14 days without giving reasons. The right of withdrawal does not apply to business customers. The reflection period starts:
a. when purchasing products on the day after delivery of the product to you or a third party designated by you, who is not the carrier, has taken place;
b. upon the delivery of services and delivery of digital content that is not delivered on a tangible medium (such as a USB stick, CD or DVD) on the day after the agreement has been concluded;
c. in the case of a continuing performance agreement, on the day after you, or a third party designated by you, who is not the carrier, has received the first delivery;
d. in the event of the same order with multiple products on the day after you, or a third party designated by you, who is not the carrier, has received the last product;
e. in the event that the delivery of a product consists of several shipments or parts on the day after you, or a third party designated by you, who is not the carrier, has received the last shipment or part.
To exercise the right of withdrawal, you must inform us of your decision to withdraw from the contract by an unequivocal statement, for example by e-mail or in writing by post. You can use the model withdrawal form for this, which you can download by clicking on the button at the top right, but you are not obliged to do so. You can also use our online form for cancellation return request (RMA). Under “reason for return” you can indicate that it concerns a withdrawal. If you make use of this option, we will immediately send you an acknowledgment of receipt of your cancellation by e-mail.
To comply with the withdrawal period, it is sufficient to send your communication regarding your exercise of the right of withdrawal before the withdrawal period has expired.
If you revoke the agreement, you will receive all payments you have made up to that time for the returned products, including delivery and payment costs (with the exception of any additional costs resulting from your choice of a different method of delivery than the one specified by us). cheapest standard delivery offered) back from us without delay and in any case no later than 14 days after we have been informed of your decision to withdraw from the agreement. If the agreement concerns the delivery of multiple products and your cancellation does not apply to the entire delivery, the delivery and payment costs paid will not be reimbursed. We will wait with the refund until we have received the goods back. We will refund you using the same payment method as you used for the original transaction, unless you have expressly agreed otherwise; in any case, you will not be charged any fees for such reimbursement.
If you have requested that the performance of services begin during the withdrawal period, you will pay an amount that is proportional to what has already been delivered at the time you informed us that you are withdrawing from the contract, compared to the full performance of the agreement.
The delivery of digital content that is not delivered on a tangible medium, such as a CD or DVD, will only take place if you have expressly agreed prior to its delivery to commence performance of the agreement (delivery) before the end of the cooling-off period and you have acknowledged that you lose your right of withdrawal when granting this consent. The contract for the supply of digital content cannot therefore be revoked and, if we have confirmed your consent and acknowledgment, you will bear the costs for the full or partial delivery of digital content not delivered on a tangible medium.
The following are further excluded from revocation:
- products or services whose price is subject to fluctuations in the financial market over which we have no influence and which may occur within the cooling-off period;
- agreements concluded during a public auction. A public auction means a method of sale whereby products, digital content and/or services are offered by us and you are personally present or have the opportunity to be personally present at the auction, under the supervision of an auctioneer, and where the successful bidder is obliged is to purchase the products, digital content and/or services;
- products or digital content manufactured according to your specifications, which are not prefabricated and which are manufactured on the basis of an individual choice or your decision, or which are clearly intended for a specific person, including, but not limited to: configuring or assembling of the product and providing the product with (new) software and/or firmware;
- products or digital content that spoil quickly or have a limited shelf life;
- sealed products that are not suitable for return for reasons of health protection or hygiene and of which the seal has been broken after delivery;
- products or digital content that are irreversibly mixed with other products or digital content after delivery;
- products or digital content that are activated or registered as soon as they are connected and/or switched on or used;
- sealed audio, video recordings, software and all other digital content, the seal of which has been broken after delivery;
- newspapers, periodicals or magazines, with the exception of subscriptions thereto; and
- a gift voucher.
You must return or hand over the goods to us without delay, but in any case no later than 14 days after the day on which you communicate your decision to withdraw from the contract to us. You are on time if you return the goods before the period of 14 days has expired.
The direct costs and risk of returning the goods are at your expense. You are only liable for any diminished value of the goods resulting from use of the goods that goes beyond what is necessary to establish the nature, characteristics and functioning of the goods. The basic principle here is that you may only handle and inspect the product as you would in a store. The product and packaging must be suitable for resale by us. This means, among other things, that you must return the product with all accessories supplied, free from signs of wear and in the original condition and packaging. There must be no writing, stickers, tape or labels on the product and the original packaging. Products that can be configured with your own login details and settings must be restored to factory settings before being returned. If the product is returned with your own login details or with a link to your own account or mobile app, we can no longer access the product and a reduction in value will occur in the event of a withdrawal.
Returns must be properly packaged and in the original packaging in which the product was received. An outer box (outer carton) and suitable padding materials must be used. If reusable, the outer box and filling material in which the product was delivered can be used. The return shipment must have sufficient postage.
